Terms of Service

These terms cover your use of PlantCase, operated by Xperion LLC ("we", "us"), through ChatGPT and on our website. By using PlantCase you agree to them. If you do not agree, do not use it.

What PlantCase is

PlantCase helps gardeners and farmers work out what might be wrong with a plant, ask for better photos, track a problem over time, and see whether it keeps appearing in their own saved cases. The assessment comes from the AI model in your ChatGPT, guided by our rules. We save and organise the results. It covers pests and diseases only, not nutrients, soil or what to plant.

It can be wrong

This matters more than anything else in these terms.

• A photo cannot give a definite diagnosis, and look-alike problems are often impossible to tell apart from one picture. Expect mistakes, especially with unusual plants or regional pests.
• It is not professional agricultural, plant health, legal or safety advice. For anything serious, spreading, or involving a crop you depend on, ask a local agricultural adviser.
• We do not give pesticide doses or mixing instructions. If you use a chemical product, use only one registered for your plant and problem, and follow its label and the rules that apply to you.

You decide what to do with the information, and you carry the risk of those decisions.

Using PlantCase

You must be able to form a binding contract and be at least 16 years old. You are responsible for what you upload and for activity under your account.

Please do not upload content you have no right to share or that is illegal or abusive, attack or overload the service, scrape or copy it, try to read other people's data, or use automated tools beyond normal personal use. We may limit or suspend access if you break these rules or put the service at risk.

Your content

You keep ownership of your photos and notes. You give us a limited licence to store, process and show them back to you so we can run the service. That licence ends when you delete the content. We do not use your content to train AI models.

Plans and payment

PlantCase has Free and paid plans, which differ in how many cases you can save. They are described on our Plans page, and paid plans are bought on our website, not in ChatGPT. Payments are handled by Stripe, and we never see your card number.

A subscription renews automatically each month or year until you cancel. You can cancel at any time in your account's billing page and keep access until the end of the period you have paid for. The price is shown before you pay. If we change a price, it applies from your next renewal and we will tell you first. Taxes may be added.

Except where the law gives you a right to a refund, payments are not refundable. If you were charged by mistake, or you could not use PlantCase because of a fault on our side, contact us within 14 days of the charge and we will review it.

If a payment fails, your plan returns to Free once Stripe stops retrying. Nothing you saved is deleted, but you may not be able to add new cases above the Free limit.

Other services

You use ChatGPT under OpenAI's terms. We are not part of OpenAI, and OpenAI does not endorse this service. Sign-in is provided by Auth0 and payments by Stripe, each under its own terms. We are not responsible for them.

Availability

We aim to keep PlantCase running but do not promise it will always be available or error-free. We may change, pause or end it. If we end it, we will give reasonable notice where we can, and a chance to delete your data.

Our rights

PlantCase, its design and its code belong to us or our licensors. If you send us feedback, we may use it without owing you anything.

Warranties and liability

To the extent the law allows, PlantCase is provided "as is" and "as available", without promises about accuracy, fitness for a particular purpose or results. We are not liable for lost crops, yields, income, profits or other indirect or consequential losses. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and USD 100.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury.

Ending your use

You can stop at any time and delete your data through PlantCase. We may suspend or end your access if you break these terms or the law, or if we end the service. Ownership, disclaimers, liability limits and disputes continue after that.

Disputes

If you have a problem with PlantCase, please raise it with us first and give us a chance to resolve it.

Changes

We may update these terms. If a change matters, we will update the date and, where we can, tell you in the service. Continuing to use PlantCase afterwards means you accept the new terms.

General

These terms and our Privacy Policy are the whole agreement between us about PlantCase. If part of them is unenforceable, the rest stays in force. We may transfer our rights as part of a business sale or reorganisation. You may not transfer yours without our consent.
